Spy App

The application Tempo de Saber promises to be an “all-seeing spy app.” It is available on a sales page, where a video shows images of half-naked women who are supposedly being accessed by a third party’s cell phone. In the first available testimonial, a woman says she is married to a truck driver and is using the app to monitor everything her husband does on the device, in search of any infidelity. She says the app is invisible.

Just like her, other people have videos with similar testimonies. Soon after, the video presents the fact that 95% of people start cheating through of messages exchanged. However, there is no research source presented that shows this reported percentage.

Announcement

Another suspicious fact is that the alleged developer of the app, who presents himself as Daniel in the video, is presented on the sales page as Patrick. The app's sales page is hosted on Perfect Pay.

According to the lawyer specializing in civil proceedings, Mariana Ribeiro, who was interviewed by Olhar Digital, this application does not act within the law, as it commits a crime against the inviolability of privacy and private life, which consists of protecting data and information stored on the victim's device.

Sales

The application is sold for R$67.00 and appears with the information that it has a discount of R$230.00, since its original price would be R$279.00. There are no detailed explanations of how the application works, nor whether the person needs to have access to the device that will be monitored, leaving several doubts about its operation.

According to article 154 A of the Penal Code, it is a crime to invade a computer device used by another person, whether or not connected to a computer network, with the aim of obtaining, tampering with or destroying data or information without the user's authorization.

On the app's sales page, you can identify typing errors and the promise of a 7-day refund if it doesn't work.

According to the lawyer, if this type of invasion results in economic loss, the sentence may be increased by one to two thirds. If it results in access to private or confidential information, the prison sentence may be up to 5 years, in addition to the payment of a fine.

With this, the person who accesses or installs monitoring devices on WhatsApp of other people without authorization, is criminally liable and can be converted into moral and material damages for the damages caused.
