A hacker managed to impersonate a user of Instagram and made a series of different publications with the intention of obtaining undue advantage in the account of the person who was harmed.
The user in question who had his Instagram profile hacked will receive compensation of up to R$5,000 for moral damages. The decision was communicated by the Sixth Special Civil and Consumer Relations Court of São Luís/Maranhão, which took the decision to condemn the social platform.
In the lawsuit, the plaintiff stated that he has an Instagram account and that he has approximately 11 thousand followers. The plaintiff claims that in January 2021, his profile was hacked with the intention of promoting illegal activities. Due to the numerous complaints that were made, without obtaining a Instagram response, he sought justice to restore his profile and obtain compensation for moral damages.
Instagram, in turn, argued that the actor had neglected to protect his account, and that because of this, he was not at fault for the incident. During the ruling, the decision of the Sixth Court recorded that the author, upon learning of the facts, took all necessary measures to communicate with the company and to have his Instagram account reinstated.

The judge's decision in that court was that Facebook/Instagram had every possibility of solving the problem and then did not do so at any time. Thus, this ended up constituting moral damage and harm resulting from the aggression against the person's dignity, causing anger, hurt or sadness in a person.
Ultimately, the judge's decision was to convict the Facebook to proceed with the recovery of the author's account, in addition to starting to make the payment set at R$ 5 thousand for compensation for moral damages.
